The aim is to donate that money to cover Ward's expenses. The Background Almost 2 years ago, Helmut Hullen (HH) was excommunicated by his NC, re-listed by the former RC24 and then again excommunicated by RC24, before he was finally excommunicated by Z2C, Ward Dossche (WD). HH threatend both RC24 and Z2C with a lawsuit if he wasn't re-listed. RC24 gave in and re-listed HH in the R24 region file. However, Z2C didn't give in, and HH took him to a Belgian court approx. 1.5 years ago. Just a few days ago, this Belgian court rejected HH's plea; HH lost, and WD won the suit. BTW, this was not HH's first FidoNet-related lawsuit. Even before the present case, he sued another R24 sysop. HH also lost that suit... Why a collection within FidoNet? WD was not taken to court for some private dispute with HH. He was taken to court for a FidoNet matter, a *C decision based upon Policy 4.07. WD was representing FidoNet in court, and he was fighting for FidoNet in court. Michiel van der Vlist, who started a collection in R28, wrote in Enet.Sysop: "Well I guess all of FidoNet has won. So co[n]gratulations to us all." I think it is only fair that we, the members of FidoNet, demonstrate our solidarity by making a small financial contribution to WD's expenses for FidoNet. Approx. 30 nodes/points in R24 have already done that (see below). What are WD's expenses and what will be donated? Although he won the case, WD will have to pay more than 1000 Euros for lawyer and court costs (according to Belgian law). I hope to get a detailed list of all lawsuit-related expenses soon. WD will only be given the amount of money he actually spent defending against this lawsuit, and which will not be reimbursed from another source, for example insurance. If this collection assembles more money than needed - and that is already the case - each person's donation will be reduced by an appropriate percentage. Therefore, the more people donate money, the less each individual will actually pay. If only every tenth node in Z2 would donate one Euro (and a few Cents), WD's costs would be fully covered! So, please, consider a donation even if the required amount of money has already been collected! The Collection Please send an Echomail or write a Netmail (2:2426/1111) indicating how much you want to donate. I will collect these messages until the end of July 2002. By then I will also have a detailed list of all lawsuit-related expenses.
